Section 67 IT Act

What are the penalties if I share obscene content online?

Short answer

You may be sentenced to up to three years in jail and fined up to five lakh rupees for a first offence.

In detail

If a person publishes, sends, or causes any material that is sexually explicit, lewd, or likely to corrupt viewers to be shared in electronic form—such as on the internet, email, or messaging apps—the law treats this as a serious offence. On the first conviction, the court can order imprisonment for any length of time, but not exceeding three years, and may also impose a monetary fine that can go up to five lakh rupees. If the same person is convicted again for the same type of conduct, the punishment becomes harsher: the jail term can be extended to a maximum of five years, and the fine can rise to as much as ten lakh rupees. The aim of the rule is to deter the spread of material that could degrade moral standards or corrupt those who might see it, especially when the content is easily accessible through digital means.
