Section 41 Consumer Protection Act

Can I appeal a District Commission order if I missed the 45‑day deadline?

Short answer

Yes, you may still appeal, but only if the State Commission accepts your reason for delay and you meet any deposit requirement.

In detail

If a District Commission issues an order that you disagree with, you have the right to challenge it by filing an appeal with the State Commission. Normally you must do this within 45 days of the order, and you must follow the prescribed form and procedure. However, the State Commission can allow a later filing if it is convinced that you had a sufficient cause for not filing on time. Additionally, if the original order requires you to pay money, the State Commission will not consider your appeal unless you first deposit half of that amount as directed. Finally, appeals are not allowed against orders that result from a mediation settlement under section 80, as specified in section 81(1). So, while a missed deadline does not automatically bar you, you must show a valid reason for the delay and, if applicable, provide the required deposit before the appeal can be heard.
