BNS Section 83

What is the punishment for taking part in a marriage ceremony that is not legally valid?

Short answer

You can be sentenced to up to seven years in prison and also be fined.

In detail

The law says that any person who, with dishonest or fraudulent intent, goes through a marriage ceremony while knowing that the ceremony does not create a legal marriage commits an offence. The key elements are the knowledge that the marriage is not lawful and the dishonest or fraudulent purpose behind taking part. If a person meets both conditions, the court may impose a term of imprisonment that can last as long as seven years. In addition to jail time, the offender is also liable to pay a monetary fine. The provision applies to anyone who participates in such a ceremony, whether they are the bride, groom, officiant, or any other participant who knowingly acts with fraud. The punishment is intended to deter people from pretending to be married when the law does not recognise the union.
