BNS Section 336

What punishment can I face for creating a false document or electronic record?

Short answer

Forgery can lead to up to two years’ jail or a fine, but up to seven years if used for cheating, or up to three years if meant to harm reputation.

In detail

Under Section 336 of the Bharatiya Nyaya Sanhita, 2023, making a false document or electronic record with any dishonest intent is called forgery. If you are found guilty of forgery, the law allows a court to impose imprisonment for a term that may be as long as two years, a monetary fine, or both. However, the punishment becomes harsher if the forged document is intended to be used for cheating; in that case, imprisonment can extend up to seven years along with a fine. Similarly, if the forged document is created to damage someone's reputation, the law permits imprisonment for up to three years and a fine. The severity of the sentence depends on the purpose behind the forgery, as specified in the statute.
