BNS Section 310

What punishment does a person face for being involved in a dacoity (group robbery)?

Short answer

Being part of a dacoity can lead to life imprisonment or up to ten years of rigorous imprisonment, plus a fine, with harsher penalties if murder occurs.

In detail

A dacoity is defined as a robbery or attempted robbery carried out by five or more people acting together, or when the total number of participants, including those present and helping, reaches five. Anyone who commits, attempts, or aids such an act is guilty of dacoity. The law prescribes life imprisonment or rigorous imprisonment for up to ten years, along with a fine, for those directly involved. If the group commits murder while carrying out the dacoity, every member can be sentenced to death, life imprisonment, or at least ten years of rigorous imprisonment, plus a fine. Even preparing for a dacoity attracts up to ten years of rigorous imprisonment and a fine. Simply assembling with the purpose of committing dacoity can result in up to seven years of rigorous imprisonment and a fine. Belonging to a gang that habitually engages in dacoity carries a penalty of life imprisonment or up to ten years of rigorous imprisonment, plus a fine.
